Privacy Policy

Last Updated: 24 January 2026

1. WHO WE ARE

This Privacy Policy applies to James Harry Ball T/A osci-render ("we", "us"). We are the Data Controller for your information.

Contact Email: [email protected]
Location: London, United Kingdom

2. DATA WE COLLECT

When you purchase or download any of our products (including current products such as osci-render and sosci, and any future products we may offer) via our third-party resellers and distribution platforms (including Gumroad or Payhip), we may receive and store the following information:

  • Identity Data: Your name (as provided at checkout).
  • Contact Data: Your email address.
  • Transaction Data: Details of the product you obtained and the date of purchase.
  • Technical Data: We do not track your usage of our software unless you explicitly opt-in to specific telemetry (if applicable).

Note: We do not see or store your credit card details. These are handled entirely by Gumroad/Payhip (or the applicable reseller/platform).

3. HOW WE USE YOUR DATA

We use your data strictly to:

  • Fulfil the Contract: Send you download links and, where applicable, license keys.
  • Support: Respond to your help requests.
  • Legal Obligations: Keep tax records as required by HMRC (UK tax law).
  • Updates: Notify you of critical bug fixes or updates (only if related to your purchase or download).
  • Marketing: Send you emails about similar products and services we offer (for example, new releases, major updates, or promotions for our current and future products). Where this is done following a purchase, you will be given a way to opt out of marketing (for example, via a link in your receipt and/or in the email). Depending on the reseller/platform you use (for example, Payhip), you may also be offered an opt-out checkbox at checkout. You can opt out of marketing at any time by using the unsubscribe link or by emailing us at [email protected]. If you opt out, we may keep a record of your request to ensure we respect it.

Legal basis (UK GDPR): Our legal basis depends on the context and the specific processing activity. Typically:

  • Contract: Where processing is necessary to supply the product (e.g., providing downloads/license keys).
  • Legal obligation: Where we must keep records for tax/accounting purposes.
  • Legitimate interests: Where we process data to provide customer support and maintain the security and integrity of our business, provided those interests are not overridden by your rights.
  • Consent (where required): For certain marketing communications or similar activities where consent is required under applicable law. In all cases, you can opt out of marketing as described above.

4. SHARING YOUR DATA

We do not sell your data. We share data only with:

  • Service Providers: Gumroad Inc. and Payhip Ltd (and/or any other third-party reseller/platform you choose to use) who process your payment and deliver the file.
  • Legal Authorities: HMRC or other authorities if required by law.

When you use a third-party reseller/platform, their own privacy policies will also apply. You can review them here:

5. INTERNATIONAL TRANSFERS

Because our payment and distribution providers (e.g., Gumroad/Payhip) operate globally, your data may be processed outside the UK. We rely on their compliance with standard contractual clauses and adequacy decisions to help protect your data.

6. DATA RETENTION

We keep customer records for 6 years to comply with UK tax laws (HMRC). After this, data is deleted or anonymized.

7. YOUR RIGHTS

Under the UK GDPR, you have the right to request access to your data, correction of errors, or deletion (where not required for tax purposes). You also have the right to object to direct marketing at any time. Contact us at the email above to exercise these rights.

8. COOKIES AND WEBSITE ANALYTICS

8.1 Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC ("Google"), to help us understand how visitors use our website. Google Analytics may process online identifiers (cookies), device/browser information, approximate location, and pages viewed/interactions.

Your Choices: In countries where consent is required for analytics cookies (including the UK/EEA), we only run Google Analytics if you choose “Allow analytics” in our cookie banner. In other countries, we may run Google Analytics by default. In all cases, you can disable analytics at any time via the “Cookie Preferences” link in the site footer. When you disable analytics, we attempt to remove Google Analytics cookies from your browser, but some cookies may be managed by your browser or by Google and may not be fully removable from our side.

International Transfers: Google may process analytics data on servers outside the UK/EEA.

Data Retention: Our Google Analytics user-level data retention is configured to 14 months.

Legal Basis: Where consent is required for analytics cookies, our legal basis is your consent. Elsewhere, our legal basis is our legitimate interests in understanding and improving our website (subject to your right to opt out as described above).

Opt-Out (Alternative): You can also opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

For more information, see Google's Privacy Policy.

8.2 Other Cookies

In addition to Google Analytics, third-party services you interact with on our website (for example, opening a checkout provided by Payhip or Gumroad, or viewing embedded media) may set their own cookies or collect information under their own privacy policies. We do not control these third-party cookies.

8.3 Managing Cookies

On-site controls: You can change your analytics cookie preference at any time by clicking “Cookie Preferences” in the site footer.

Strictly necessary cookie: When you make a choice in the cookie banner, we store it using a cookie (currently named osci_cookie_consent) so we don’t keep asking you on every page. We currently remember this choice for up to 6 months.

8.4 Geo-based Consent

To decide whether we need to show the cookie banner in the first place, we may use Cloudflare’s geo-location data to determine your country. This is based on Cloudflare’s request metadata (derived from your IP address). We do not receive your IP address from this process, and we do not store a copy of your IP address for this purpose.

This geo check is a best-effort approach and may be inaccurate (for example, if you use a VPN). If the geo check fails, we default to showing the cookie banner.

If you believe you are in a consent-required region and analytics appears enabled, you can disable it at any time via “Cookie Preferences” in the site footer.
