1. INTRODUCTION

These Terms and Conditions ("Terms") govern the supply of the software binaries for the product(s) selected by you at checkout, including but not limited to osci-render and sosci (collectively, the "Software") by James Harry Ball T/A osci-render ("we", "us", or "our"), a sole trader established in the United Kingdom, to you ("you" or "Licensee"). By checking the "I agree to the Terms & Conditions" box at checkout, you explicitly agree that this contract is formed in the United Kingdom and is subject to the jurisdiction set out below.

2. JURISDICTION AND GOVERNING LAW

  1. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.
  2. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

3. LICENSING AND USAGE

  1. The Software is a derivative work based on components licensed under the GNU General Public License v3 (GPLv3).
  2. Accordingly, your rights to use, copy, modify, and distribute the Software are governed by the terms of the GPLv3. Nothing in these Terms restricts the freedoms granted to you by the GPLv3.
  3. These Terms apply specifically to the service of supplying the binary files, the transaction of purchase, and the limitations of our liability to you.

4. LIMITATION OF LIABILITY

  1. The Software is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of satisfactory quality, merchantability, or fitness for a particular purpose.
  2. To the maximum extent permitted by law:
    1. We shall not be liable for any indirect, special, incidental, or consequential damages, including loss of data, loss of profits, or business interruption (e.g., failed renders or project delays), arising out of the use or inability to use the Software.
    2. Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you actually paid for the Software.
  3. Nothing in these Terms limits our liability for death or personal injury caused by our negligence or for fraud.

5. UPDATES AND SUPPORT

  1. No Support: The purchase of the Software does not include any dedicated technical support. We may provide support via email at our sole discretion, but we make no guarantee of response times or solutions.
  2. Updates and Versioning: Your purchase constitutes a license for the specific Major Version of the Software available at the time of purchase (e.g., v1.x). You are entitled to download minor updates and patches (e.g., v1.2, v1.3) released for that Major Version for the lifetime of that version. Future Major Versions (e.g., v2.0), which may include significant feature additions or architectural changes, are considered separate products and are not included in this purchase.
  3. End of Life: We reserve the right to discontinue the distribution or development of any Major Version at any time without ongoing liability.

6. REFUNDS (30-DAY GUARANTEE)

  1. We offer a 30-day money-back guarantee. If you are not satisfied with the Software, you may request a full refund within 30 days of your purchase date.
  2. To request a refund, you must contact us at [email protected] with your order details. Upon processing a refund, your agreement with us for the supply of the Software is terminated.

7. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions of these Terms remain in full force to the extent permitted by law.
